Terms of Service

By accessing or using FellowConn's platform, mobile applications, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree with any part of these Terms, you must not use our Service. These Terms apply to all visitors, users, and others who access or use the Service.

FellowConn provides a push-to-talk (PTT) communication platform that turns smartphones into digital walkie-talkies. Our Service includes:

•Real-time voice push-to-talk channels

•Text and file messaging

•Group and private communication channels

•Administrative dashboard for team management

•iOS and Android mobile applications

•Web-based management console

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

Account Creation: To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and keep your account information updated.

Account Security: You are responsible for safeguarding your password and for all activity that occurs under your account. Notify us immediately at info@fellowconn.com if you suspect unauthorized use of your account.

Account Types: Organizations may designate administrators who can manage users, channels, and permissions. Administrators are responsible for ensuring their users comply with these Terms.

Eligibility: You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must NOT:

•Transmit any content that is unlawful, harassing, threatening, abusive, defamatory, or invasive of another's privacy

•Impersonate any person or entity or misrepresent your affiliation with any person or entity

•Upload or transmit viruses, malware, or any other malicious code

•Attempt to gain unauthorized access to any part of the Service or its infrastructure

•Use the Service to transmit unsolicited communications ("spam")

•Engage in any activity that interferes with or disrupts the Service

•Reverse engineer, decompile, or disassemble any part of the Service

•Use the Service in any way that could damage, disable, or impair our systems

•Resell or commercialize the Service without our express written permission

Our IP: The Service and its original content, features, and functionality are and will remain the exclusive property of Absolute Softwares Ltd. and its licensors. Our trademarks, logos, and trade names may not be used without our prior written consent.

Your Content: You retain ownership of content you submit through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process your content solely to provide and improve the Service.

Feedback: If you provide us with feedback or suggestions about the Service, we may use this information without restriction or compensation to you.

Billing: Paid plans are billed in advance on a monthly or annual basis. By providing payment information, you authorize us to charge the applicable fees.

Price Changes: We reserve the right to change pricing at any time. We will provide at least 30 days' notice before any price changes take effect for existing subscribers.

Refunds: Refunds are provided at our discretion. Annual subscriptions may be eligible for a prorated refund within the first 30 days. Monthly subscriptions are non-refundable.

Taxes: You are responsible for all applicable taxes arising from your use of the Service.

Free Tier: Our free tier is provided as-is and may be modified or discontinued at any time. We will provide reasonable notice before discontinuing free tier features that users rely on.

By You: You may terminate your account at any time by contacting us at info@fellowconn.com or through your account settings. Termination does not entitle you to a refund for any unused portion of a paid subscription, except as required by law.

By Us: We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms, is harmful to other users, us, or third parties, or for any other reason.

Effect of Termination: Upon termination, your right to use the Service will immediately cease. We may delete your account data after a grace period of 30 days.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FELLOWCONN DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Service will be uninterrupted or error-free; (b) any defects will be corrected; (c) the Service or the servers that make it available are free of viruses or other harmful components.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FELLOWCONN, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (I) THE AMOUNT PAID BY YOU TO FELLOWCONN IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (II) ONE HUNDRED U.S. DOLLARS ($100).

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Dispute Resolution: You and FellowConn agree to resolve any disputes through binding arbitration, except that either party may bring claims in small claims court. You waive any right to a jury trial or to participate in a class action.

Informal Resolution: Before filing a formal claim, we encourage you to contact us at info@fellowconn.com. We will attempt to resolve disputes within 30 days.

We reserve the right to modify these Terms at any time. We will provide notice of significant changes via email or a prominent notice on our website at least 14 days before the changes take effect.

Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the Service.
